The November 2009 issue of Dallas Child Magazine, features an article on Estate Planning Options to Help Protect your Children (and your Money). The article emphasizes that it is essential for anyone with children to have a will and an estate plan that protects and provides for your children and accurately. Failure to address these issues in your estate plan leaves these important decisions in the hands of a Judge. The Judge is required to follow certain default provisions in the law which could have unintended consequences and create unnecessary expenses that can be avoided with even the most basic estate planning. Why Conduct Employee Background Checks?

Employers in Texas have a legal duty to hire competent employees that do not pose a danger in the workplace or to the public. A breach of this duty may result in liability for a negligent hiring claim. Conducting employee background checks on job applicants is one way to help defend against such a claim (and is required by statute for certain employers). Background checks may also prevent the hiring of an employee that could cause harm to your business or its reputation. Before conducting a background check; however, employers should be aware that there are several state and federal laws that govern when and how to conduct a background check. For instance, the check should only be run after you have made an actual job offer to the applicant, which is contingent on passing the check. The type of background check must also relate to the job offered (ex: driving record for delivery driver) and the check must be run on all persons offered that job (ex. not just females). Specific notice and consent forms are also required, particularly if an outside company is conducting the background check.
