Mediation “Think Outside of the Box”.
Mediation is a process of resolving disputes between parties out of court that is used in many different areas of the law. In fact, mediation is often a requirement of the courts before you can proceed to trial in your case.
When people are involved in a dispute, they often have a difficult time believing that they would be able to settle their differences with the opposing party without a judge banging his gavel and declaring what each party is awarded or required to do. In reality, mediation is generally quite successful and most clients are more satisfied that they got to have some control over the outcome of their case versus having a judge hear the evidence and make a ruling that is potentially quite different from the client’s own expectations.
Parties often find mediation quite liberating, because they can craft a settlement that is potentially quite different than what a judge would be able to order within the boundaries of the applicable law. While the law serves as a guide, there is much more freedom to “think outside of the box” in mediation versus the limitations of the law in the courtroom.
