Obtaining a Fair Child Support Result

Divorce only ends marriage. It does not end either parent's legal obligation to provide financial support for the care and upbringing of their children.

How Much Can You Expect to Pay or Receive?

Texas' child support statute includes presumptive guidelines for monthly support for children in one household. Essentially, the formula is based on the non-custodial parent's net monthly income (currently capped at $7500) and the number of children to be supported. The actual statutory guidelines are as follows:

Keep in mind, these are guidelines. Courts do have the discretion to deviate from these guidelines based upon the facts and circumstances in each case. For instance, if the child custody agreement has provided for equal, or nearly equal parenting time, a judge may order a reduced support amount or even no monthly child support. Other factors that judges may take into account include the ages and particular needs of the children involved and existing child support obligations for children from previous marriages.
