In most cases, it is because one or both spouses are so angry at each other or hurt by the situation that their parenting abilities are diminished – they can no longer think clearly about the situation and they wind up making choices that put their children squarely in the middle.

Child Custody Laws and Options In Texas

The legal term used to describe what most people think of as child custody is actually called "conservatorship." In a divorce, the basic presumption is that both parents will serve as "joint managing conservators" of the children. Despite how that sounds, this does not necessarily mean equal time or decision-making authority for both parents.  For instance, both parents cannot serve as the primary residential parent. One or the other normally has to be chosen. In addition, issues such as parenting time, grandparents, allegations of abuse and child support can complicate the situation further.
